IMPORTANT: Please review the following terms and conditions carefully. These Terms and Conditions are a legally binding agreement between you and American Lebanese Syrian Associated Charities, Inc. (“ALSAC” or “our” or “we” or “us”) the fundraising and awareness organization for St. Jude Children’s Research Hospital (“St. Jude”) pertaining to the access and use of the services offered, and all products, information, content, media, printed materials, and “online” or other electronic documentation accessible from St. Jude My Supporter Account (the “Site”).
User Obligations
You represent that You are at least eighteen (18) years of age (or the legal age of majority if greater) and will, at all times, provide lawful and accurate information. Individuals under the age of eighteen (18) (or the legal age of majority) may utilize the Site only with the involvement and acceptance of these Terms and Conditions by a parent or legal guardian and then solely under such parent or legal guardian’s supervision. You also agree to abide by all applicable local, state, and federal laws and regulations with respect to Your use of the Site which you access voluntarily.
Proprietary Rights
These Terms and Conditions provide only a limited license to access and use the Site. Accordingly, You expressly acknowledge and agree that We transfer no ownership or intellectual property interest or title in and to the Site to You or anyone else. This Site and its contents are copyright protected by US. All rights reserved. ALSAC and St. Jude and all other names, designs, logos, and icons identifying St. Jude and its programs, events, solutions, or services are proprietary trademarks of ALSAC / St. Jude and any use of such marks, including without limitation, as domain names, without the express written permission of ALSAC is strictly prohibited.

JUDE’S LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT ALLOWED BY LAW. THE INFORMATION AND MATERIALS AVAILABE ON OR THROUGH THE SITE ARE PROVIDED ON AN “AS-IS” AND “AS AVAILABLE” BASIS AND MAY INCLUDE ERRORS, OMISSIONS, OR OTHER INACCURACIES. ALSAC / ST. JUDE HEREBY EXPRESSLY DISLCIAMS ALL WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY AND CONDITION OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PRUPOSE, OR NON-INFRINGEMENT OR ANY OTHER IMPLIED WARRANTY UNDER THE UNIFORM COMPUTER INFORMATION TRANSACTIONS ACT AS ENACTED BY ANY STATE OF THE U.S. ALSAC / ST. JUDE ALSO MAKES NO REPRESENTATIONS OR WARRANTIES THAT THE SITE WILL OPERATE ERROR-FREE, UNINTERRUPTED, OR IN A MANNER THAT WILL MEET YOUR PARTICULAR REQUIREMENTS AND/OR NEEDS.
Indemnification
You agree to defend, indemnify, and hold harmless ALSAC / St. Jude, their respective directors, officers, and employees from any and all claims, demands, liabilities, lawsuits, settlements, actions, damages and expenses whether or not litigation is commenced arising out of or related to your access or use of, or your inability to access or use, the Site. You will also defend, indemnify and hold harmless ALSAC / St. Jude, their respective directors, officers, and employees pertaining to the use of the information and content provided by you in connection with the services, your failure to abide by the Terms and Conditions set forth herein, your willful misconduct or gross negligence, or any patent, copyright, trademark of other intellectual property right or right of publicity or privacy of any third party that relates to any information, image, name or content provided by you in connection with the Site, even if such claims, damages, liability or expense are based on whole or in part on ALSAC / St. Jude’s own negligence.
Limitation of Liability
In no event under no circumstances shall ALSAC / St. Jude be liable to you or any third party for special, incidental, punitive, or consequential damages. YOU EXPRESSLY ABSOLVE AND RELEASE ALSAC / ST. JUDE, THEIR RESPECTIVE DIRECTORS, OFFICERS AND EMPLOYEES FROM ANY CLAIM OF HARM RESULTING FROM YOUR USE OF THIS SITE. AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ALSAC / ST. JUDE, THEIR RESPECTIVE DIRECTORS, OFFICERS AND EMPLOYEES BE LIABLE FOR ANY DIRECT, PUNITIVE, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THIS SITE, WITH THE DELAY OR INABILITY TO USE THE SITE, LOSS OF DATA, OR THE FAILURE TO STORE ANY INFORMATION OR MATERIALS AVAILABLE THROUGHTHE SITE, WHETHER BASED ON CONTRACT, TORT, EXTRACONTRACUAL LIABILITY, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF ALSAC / STJUDE, THEIR RESPECTIVE DIRECTORS, OFFICERS AND EMPLOYEES HAVE BEEN ADVISED OF SUCH DAMAGES.
Construction
The Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Tennessee. You submit to the exclusive jurisdiction of and venue in the appropriate courts located in Memphis, Tennessee.
Term & Termination
The Terms and Conditions are effective from the date that you first access the Site or on the date that you activate your account, whichever is earlier, and continues in effect until terminated by ALSAC. ALSAC / St. Jude may terminate the Site and your access to the Site at any time for any, or no, reason. Cause for termination may include, but not be limited to, breach or violation of these Terms and Conditions. You agree that termination of your account and/or your access to the Site may be made effective without prior notice and you agree that ALSAC / St. Jude may immediately deactivate or delete your account.
Severability
If any term or provision of these Terms and Conditions should be declared invalid by a court of competent jurisdiction, the remaining terms and conditions shall be unimpaired.
Entire Agreement
Please note that ALSAC / St. Jude reserves the right to change the terms and conditions of this Site by posting revised Terms and Conditions on the Site (which shall constitute reasonable notice). ALSAC / St. Jude may add, modify, or delete any aspect, program, or feature of the Site and ALSAC / St. Jude is under no obligation to add any upgrade, enhancement or modification. Your continued use of the Site following any changes will be conclusively deemed acceptance of any change to the Terms and Conditions.
